Brarista ("us", "we", or "our") operates the website www.brarista.fit (the "Website"). This Privacy Policy explains how we collect, use, and protect your personal information in accordance with the statutory requirements set out in the Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR) (the “Data Protection Legislation”).

This Privacy Policy will apply when you use our Website, including:

  1. our proprietary chat software application (the “ChatBot”); or 

  2. any of our other services (the “Non-Chat Services”).

By using any of our services, you agree to the collection, processing and use of personally identifiable information (“Personal Data”) in accordance with the terms of this policy. 

  1. The ChatBot

Customer Users

We may licence our ChatBot to business customers (“Customers”). In such a case, the ChatBot will appear on the Customer’s website or platform. In such as case any personal data which a user inputs into the ChatBot will be collected, processed and managed by us on behalf of our Customer. 

In such a case, we will be acting as a Data Processor (as defined in the Data Protection Legislation) and we will be processing any Personal Data on behalf of and under the instruction of the respective Customer, in accordance with our Data Processing Agreement which we have with them. 

Accordingly, this Privacy Policy will not apply to that processing as it is carried out on our Customer’s behalf. In such a case, the Customer will be the Data Controller (as defined in the Data Protection Legislation), and your data protection rights will be covered by the Customer’s own privacy policy. 

Brarista Users 

Users who access the ChatBot through our Website will be covered by the terms of this Privacy Policy in respect of any Personal Data which we may collect. 

1. Information Collected by our ChatBot

Our ChatBot is not designed to request or require a user to input any Personal Data. Therefore, we would expect that, generally, no Personal Data will be collected. In such cases, the terms of this Privacy Policy will not be applicable.

In the unlikely event that a user chooses to insert into the ChatBot any Personal Data in the course of using the ChatBot, that information will be collected and processed in accordance with the terms of this Privacy Policy.

2. How We Use Your Information

We may use your Personal Data for the following purposes:

  • To respond to queries: If you contact us for support or with questions, we may use your information to provide assistance.

3. Data Sharing and Disclosure

We may disclose your personal data to any member of our group of companies (this means our subsidiaries, our holding company and its subsidiaries) insofar as reasonably necessary for the purposes, and on the legal bases, set out in this policy.

In these circumstances, we will require that the IT supplier only processes your personal data for us, as directed by us, and in accordance with the Data Protection Regulations.

If we sell all or part of our business, we may pass your personal data to the purchaser. In these circumstances, we will require the purchaser to contact you after completion of the sale to inform you of the identity of the purchaser.

In addition to the specific disclosures of personal data set out in this Section, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your legal interests or the legal interests of another person.

1. Information We Collect
